Privacy Policy

BioNote of Sweden AB (“BioNote”) is a company incorporated under the laws of Sweden with Swedish company registration no. 559033-1459. BioNote operates the mobile application BioNote (the “App”) as well as the website (the “Website”). BioNote is committed to protect the privacy of the registered users (the “User”) of the App and visitors of the Website. This Privacy Policy (the “Policy”) informs the User and visitors of the Website of the Policy regarding BioNote’s collection, use, disclosure and protection of the User’s personally identifiable information (“Personal Data”) as well as BioNote’s use of cookies on the Website.

Please read this Policy carefully before using the App and when visiting the Website.

1            General

1.1         BioNote will not ask for Personal Data unless it is required for fulfilling its obligations following from BioNote’s terms and conditions (the “Terms”), this Policy or applicable law.

1.2         BioNote will not share Personal Data in any other way than what is described in this Policy unless required to do so by law or other applicable mandatory regulation.

2            consent

2.1         By accessing the App or registering for a user account, the User confirms that he or she has understood and that he or she agrees to the terms of this Policy. The usage of the App constitutes a consent to this Policy and the terms herein.

3            personal Data

3.1         In this Policy, Personal Data refers to all information through which the User directly or indirectly can be identified. Personal Data includes, but is not limited to, names, geographical location, e-mail address and any other data through which the User can be identified.

4            collection and usage of personal data

4.1         Upon using the App for the first time, the User will be asked to provide certain information, such as his or her name, a chosen user name, gender, e-mail address and residential country. If the User login to the App by using its Facebook or Google account, Facebook or Google will automatically share and generate Personal Data about the User. Please review Facebook or Google’s privacy policy and terms for further information regarding the Personal Data they share with BioNote.

4.2         BioNote collects and uses Personal Data with the purpose to deliver, maintain and develop the App. Personal Data is required to make the functions of the App work, e.g. in order to connect Users with each other. Personal Data is also needed for BioNote to be able to keep in touch with its Users. This includes, for example, sending Users e-mails informing about new features, solicit feedback about the App or keep the User up to date regarding the App or this Policy. The User can always unsubscribe from such e-mails.

4.3         The collected Personal Data will, with this purpose, be used to:

a.        connect the User with other users and scientists,

b.       log sightings and contribute to the creation of biodiverse trail maps,

c.        contribute to research,

d.       enable secure logins,

e.        make the experience of the App more personal,

f.        facilitate a good communication between the User and BioNote, or between the User and other users,

g.        improve the App,

h.       create aggregated and non-personally identifiable information, and

i.         comply with legal obligations of BioNote.

5            disclosure of personal data to third parties

5.1         Personal Data will as a starting point be visible to the User and BioNote only. Other users of the App will be able to see some of the User’s Personal Data, such as user name and profile picture. The App has a feature through which the User can log different sightings on a specific geographical position. Hence, knowledge about the User’s stated geographical location at a certain time will be collected by BioNote and will be visible to both other users of the App as well as operators at BioNote.

5.2         BioNote undertakes not to sell, rent or trade Personal Data to third parties.

5.3         BioNote may however disclose Personal Data to:

a.      BioNote’s affiliated companies, business partners and agents, for the purpose of providing the App and contacting the User in relation to the App or for other purposes for which BioNote are using the Users’ Personal Data in accordance with this Policy;

b.      regulatory authorities or legal advisors in connection with alleged offenses or suspected breaches of this Policy;

c.      when it is reasonably necessary to (i) comply with legal or regulatory requirements, (ii) enforce or apply the Terms or this Policy, or (iii) to protect the rights, property or safety of BioNote, Bionote’s customers or others; and

d.      third parties assisting BioNote with providing the App or analyzing how the App is used. This right is limited to the purposes specified in this Policy. In such cases, BioNote remains responsible for any such third party’s processing of the Personal Data. Such third parties have access to Personal Data only to perform these tasks on BioNote’s behalf and are obligated not to disclose or use the information for any other purpose.

5.4         If BioNote or substantially all of its assets, including the App, would be acquired, or in the unlikely event that BioNote would go out of business or enter into bankruptcy, user information including Personal Data is one of the assets that most likely would be transferred or acquired by a third party. Please note that such transfers may occur, and that any acquirer of BioNote may continue to use the Personal Data as set forth in this Policy.

6            cookies

6.1         BioNote uses cookies on the Website and in the App. Cookies are alphanumeric identifiers which are stored on the visitor’s device’s hard drive through the web browser when using the Website. BioNote uses cookies to enable better functioning of the Website and the App and to collect statistics on the use of the Website and the App. BioNote also use session cookies to memorize choices visitors or Users have made during a session.

6.2         The User and the visitor can command his or her browser to refuse cookies. In such case, the User might not be able to use the App. Not allowing cookies may also cause malfunction and deterioration of the Website.

7            The user’s rights

7.1         The User has, once a year and free of charge, the right to access the Personal Data regarding him or her that BioNote as a controller process. In order to exercise this right, the User shall send BioNote a signed letter to BioNote’s registered address, found below. The User is further entitled to demand that BioNote ceases to process  Personal Data regarding the User. Please note that if BioNote receive such demand, the User will no longer be able to use the App. Regardless of such demand, BioNote will not be able to delete Personal Data that BioNote is under legal obligation to keep. Under such circumstances, the User will be notified about this.

7.2         At the User’s request, BioNote shall correct any of the Personal Data regarding the User that is found to be inaccurate, incomplete or misleading.

7.3         BioNote will process Personal Data in accordance with this Policy for as long as the User is a registered user of the App or to the extent necessary after deregistration. The User is, of course, free to unregister at any time.

8            aggregated data (non-personally identifiable)

8.1         BioNote may share and disclose aggregated information that has been compiled from Personal Data through the App. Such information may for example include statistics related to the use of the App or geographical information.

8.2         Such aggregated information cannot be used to identify any individual and is therefore not considered Personal Data and therefore not covered by this Policy.

9            security

9.1         BioNote strives to handle Personal Data with utmost care and security. Please note, however, that no method of transmission over the Internet, or method of electronic storage, is entirely sure. BioNote strives to use commercially acceptable means to protect the User’s Personal Data and to make sure it is treated securely and in accordance with this Policy. However, BioNote can never guarantee its absolute security.

10         changes to this policy

10.1      BioNote has a right to change this Policy at any time and without previous notice. To make sure that the User has been notified about the changes, BioNote will notify the User about any major changes through the App or by e-mail. The continued use of the App after any change in this Policy, constitutes the User’s acceptance of such change.
